These Terms of Service (“Terms”) govern your access to and use of the Polariyon website, content, inquiry forms, and related services (collectively, the “Services”).
By accessing or using the Services, you agree to these Terms.

1. About Polariyon
   Polariyon is a sustainability-focused brand that provides information, insights, and services relating to ESG, sustainability strategy, reporting, governance, communications, and related advisory support.
   Unless expressly stated in a separate written agreement, use of the Services does not by itself create a client-consultant relationship.

2. Eligibility
   You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Services.

3. Accounts (if applicable)
   If you create an account, you agree to provide accurate and complete information and to keep your login credentials secure.
   You are responsible for activity that occurs under your account to the extent permitted by applicable law.

4. Using the Services
   You agree not to use the Services for unlawful purposes, attempt to access non-public areas, interfere with the operation of the Services, or upload or submit content that is harmful, misleading, defamatory, infringing, or otherwise unlawful.

   While Polariyon aims to provide useful and current information, it does not warrant that any content is complete, current, accurate, or suitable for your specific circumstances.

6. Inquiries and Communications
   When you submit an inquiry, request a consultation, download a resource, or otherwise contact Polariyon, you consent to being contacted by email, phone, or messaging for the purpose of responding to your request and providing information about relevant services.
   Polariyon does not guarantee any particular response time or service outcome unless agreed in writing.

7. No Professional Advice
   Unless Polariyon has entered into a separate written engagement with you, information available through the Services does not constitute legal, financial, accounting, investment, environmental, regulatory, or other professional advice.
   You should seek appropriate professional advice before making decisions based on the Services.

8. Services, Fees, and Paid Engagements
   Browsing the website is generally free unless otherwise stated.
   If Polariyon offers paid services, workshops, reports, subscriptions, or consulting engagements, the applicable fees, scope, and payment terms will be set out at the time of purchase or in a separate proposal, order form, statement of work, or agreement.
   Any such separate written terms will govern to the extent of any conflict with these Terms.

9. Intellectual Property
   The Services, including the website design, branding, logos, text, graphics, downloads, frameworks, and other content, are owned by Polariyon or its licensors and are protected by applicable intellectual property laws.
   You may not copy, reproduce, republish, distribute, modify, or create derivative works from the Services except as permitted by law or with Polariyon’s prior written permission.

10. User Content and Feedback
    If you submit inquiries, messages, documents, feedback, comments, or other content to Polariyon, you grant Polariyon a limited, non-exclusive license to use that content to operate, deliver, improve, and support the Services.
    You represent that you have the right to submit such content and that it does not violate any law or third-party right.

11. Third-Party Links and Services
    The Services may contain links to third-party websites, software, tools, or resources.
    Polariyon is not responsible for the availability, accuracy, content, policies, or practices of third-party services.

12. Disclaimer of Warranties
    The Services are provided on an “as is” and “as available” basis to the maximum extent permitted by law.
    Polariyon disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Services will be uninterrupted, secure, error-free, or suitable for a particular objective or outcome.
    Polariyon does not guarantee that use of the Services will achieve any particular sustainability, reporting, compliance, operational, or commercial result.

13. Limitation of Liability
    To the maximum extent permitted by law, Polariyon will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity arising out of or related to your use of the Services.
    To the maximum extent permitted by law, Polariyon’s total liability for any claim arising out of or relating to the Services will be limited to the amount you paid, if any, for the specific Services giving rise to the claim during the 12 months before the event giving rise to liability.

14. Indemnification
    You agree to indemnify, defend, and hold harmless Polariyon and its affiliates, officers, directors, employees, and contractors from and against claims, liabilities, damages, losses, and expenses arising out of or related to your misuse of the Services, your violation of these Terms, or your infringement of any third-party rights.

15. Termination
    Polariyon may suspend, restrict, or terminate your access to the Services at any time if reasonably necessary to protect the Services, comply with legal obligations, or enforce these Terms.
    Sections that by their nature should survive termination will survive, including those relating to intellectual property, disclaimers, limitation of liability, indemnification, and governing law.

16. Governing Law and Disputes
    These Terms are governed by the laws of British Columbia, Canada, without regard to conflict-of-law rules.
    Any disputes will be subject to the courts located in Vancouver, British Columbia, unless otherwise required by applicable law.

17. Changes to These Terms
    Polariyon may update these Terms from time to time by posting the revised version on the website.
    Your continued use of the Services after the updated Terms become effective means you accept the revised Terms.
